TERMS OF SERVICE

1. INTRODUCTION
Welcome to Notees, an iOS app (iPhone and iPad) for organizing your personal library and reading notes.
These Terms of Service (hereafter “Terms”) govern your use of the Notees application (hereafter “the App”, “Notees” or “we”).
By installing or using Notees, you agree to be bound by these Terms. If you do not accept them, please do not use the App.
2. LEGAL INFORMATION

3. DEFINITIONS
- User: any natural person installing and using the App
- App: the Notees software, distributed on the Apple App Store
- Account: the personal space created by the User to access the Service
- Service: the set of features offered by the App
- User Content: data entered by the User (books, notes, categories, images)
- Premium Subscription: paid plan giving access to extra features and removing ads
4. WHAT THE SERVICE DOES
4.1 Description
Notees allows you to:
- Create and organize a personal book library
- Sort books into categories
- Take reading notes in text form
- Create a note from a photo using text recognition
- Sync your library and notes across devices via your account
- Back up your data in the cloud
4.2 Free and Premium versions
Notees is available in two tiers:
- Free: access to core features with ads
- Premium (subscription): ads removed, access to all advanced features of the App
5. SIGN-UP AND ACCOUNT
5.1 Account creation
An account is required to use the App. You can sign up:
- With email and password
- Via Google Sign-In
- Via Sign in with Apple
5.2 Accuracy
The User agrees to provide accurate information at sign-up and to keep it up to date.
5.3 Password confidentiality
The User is responsible for keeping their password confidential and for any activity performed under their account.
5.4 Minimum age
Notees is intended for people over 13. Between 13 and 16, parental consent is required.
6. PREMIUM SUBSCRIPTION
6.1 Where subscriptions are handled
Subscriptions are managed via Apple’s App Store. Payment processing, billing and renewal are handled by Apple under its own terms.
6.2 Auto-renewal
Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period, per Apple’s terms.
6.3 Managing and canceling
Cancellation or management happens only from your App Store account settings.
6.4 Refunds
Refund requests follow Apple’s policy. The publisher cannot process refunds directly.
6.5 Technical provider
Subscription and in-app purchase handling relies on RevenueCat (see Privacy Policy).
7. USER CONTENT
7.1 Ownership
The User retains full ownership of the User Content created in the App.
7.2 Limited license to the publisher
The User grants the publisher a non-exclusive license, limited to what is required to provide the Service (storage, display on the User’s devices, backup, sync).
7.3 Content responsibility
The User is solely responsible for User Content. They agree not to include:
- illegal, hateful, discriminatory, defamatory or pornographic content
- content protected by copyright without authorization
- personal data of third parties without a legal basis
7.4 Removal
The publisher may remove or suspend access to any User Content that is clearly unlawful and has been reported.
8. ACCEPTABLE USE
The User agrees not to:
- Circumvent or attempt to circumvent the App’s security measures
- Use the App for illegal or fraudulent purposes
- Disrupt the Service
- Reverse-engineer, decompile or disassemble the App, except where law expressly allows
- Use scripts or bots to interact with the Service
9. ADVERTISING
The free version shows ads served by Google Mobile Ads. Ad display and personalization are subject to Apple’s App Tracking Transparency prompt and, in the EU / EEA / UK, to a GDPR consent banner.
10. INTELLECTUAL PROPERTY
The App, its code, design, logos and editorial content are the exclusive property of the publisher or its partners and are protected by intellectual property law.
Any reproduction, representation, modification or unauthorized use is prohibited.
11. AVAILABILITY AND MAINTENANCE
11.1 Continuity
The publisher endeavors to keep the Service continuously available but does not guarantee uninterrupted 24/7 availability.
11.2 Maintenance
Temporary interruptions may occur for maintenance, updates or technical incidents.
11.3 Updates
The User acknowledges that the App may be updated. Some updates may be required to continue using the Service.
12. LIABILITY
12.1 Limitation
Within the limits allowed by law, the publisher is not liable for:
- indirect damages (data loss, business interruption, moral prejudice)
- issues linked to your device, your connection or third-party services
- consequences of use inconsistent with these Terms
12.2 User backup
The User is invited to keep their own backups of important content.
12.3 Force majeure
The publisher is not liable for non-performance caused by force majeure.
13. PERSONAL DATA
Personal data processing is described in the Notees Privacy Policy, which forms an integral part of these Terms.
14. TERMINATION / ACCOUNT DELETION
The User can delete their account at any time following the procedure described in the “Account deletion” document.
The publisher may suspend or terminate an account in case of clear violation of these Terms, giving reasonable notice where possible.
15. CHANGES TO THE TERMS
The publisher may amend the Terms. Material changes are flagged in the App. Continued use of Notees after a change constitutes acceptance. In case of disagreement, the User must stop using the App.
16. GOVERNING LAW AND JURISDICTION
These Terms are governed by French law. Subject to mandatory consumer rights in the country of residence, French courts have jurisdiction over any dispute related to the App.
